These General Terms and Conditions ("Terms") govern the use of the AI-DocTranslate service ("Service"), operated by ITS Mönch GmbH, Grindelwaldstrasse 94, 3818 Grindelwald, Switzerland ("Provider"). By registering for or using the Service, the user ("Customer") accepts these Terms in full. If the Customer does not agree, they must refrain from using the Service.

1. Scope of services

AI-DocTranslate is a web-based translation service that processes XLIFF and PDF documents using Claude, a large language model operated by Anthropic, PBC. The exact file types accepted depend on the configuration active for the Customer's account.

The Provider makes the Service available on a usage-based basis. No continuous availability is guaranteed; planned maintenance windows may be announced with reasonable notice. The Provider may update, extend, or restrict features at any time, provided that existing paid translation jobs are honoured.

2. Account registration

Access to the Service requires registration with a valid email address and a password. The Customer is responsible for keeping their credentials confidential. Any activity carried out under the Customer's account is their responsibility.

The Customer must be at least 18 years old and, when acting on behalf of a company, must have authority to bind that company. Accounts are not transferable.

The Provider reserves the right to suspend or delete accounts that are used in violation of these Terms, applicable law, or the Acceptable Use Policy of Anthropic, PBC.

3. Payment and pricing

The Service is offered on a pay-per-job basis. The applicable price per translation job is displayed before the Customer confirms the order. Prices are stated in Swiss Francs (CHF), Euros (EUR), or US Dollars (USD) depending on the billing configuration, and are inclusive of Swiss VAT where applicable.

Payment is processed via Stripe, Inc. The Customer's payment data is handled exclusively by Stripe according to Stripe's own privacy policy; the Provider does not store card details.

Completed and successfully delivered jobs are generally non-refundable. If a job fails due to a technical error on the Provider's side, the Customer is entitled to a credit or re-processing of the job at no additional cost.

4. File upload and data retention

The maximum file size per upload is 100 MB. Accepted formats are XLIFF 1.2, XLIFF 2.x, and PDF, subject to the configuration active for the account.

Uploaded source files and generated output files are retained for 7 days from the date of the completed job. After this period, files are automatically and permanently deleted from the Provider's servers. The Customer is responsible for downloading their results within this window.

For translation processing, document content is transmitted to Anthropic, PBC via the Claude API. The Provider does not use submitted content to train AI models. The Customer must ensure that they hold the necessary rights to submit the content and that no applicable confidentiality obligations prohibit transmission to a third-party AI provider.

5. Translation quality

AI-generated translations are produced automatically and may contain errors, omissions, or stylistic inconsistencies. The Provider does not guarantee the accuracy, completeness, or fitness for purpose of any translation output.

For documents requiring certified accuracy (for example, legal, medical, or official submissions), the Customer must have the output reviewed by a qualified human translator before use. The Provider accepts no liability for damage arising from reliance on unreviewed AI translation output.

Translations performed on XLIFF source files generally yield better structural results than PDF-based translations, due to the machine-readable format of XLIFF. Where the Customer has a choice, using XLIFF is recommended.

6. Intellectual property

The Customer retains full ownership of all source documents submitted to the Service and of the translated output generated from those documents.

The Service itself, including its interface, branding, and underlying software, is the property of ITS Mönch GmbH and is protected by Swiss and applicable international copyright law. The Customer receives a non-exclusive, non-transferable right to use the Service for their own legitimate business purposes only.

7. Prohibited uses

The Customer must not use the Service to:

  • process content that infringes third-party intellectual property rights;
  • process content that is unlawful, defamatory, or harmful;
  • circumvent technical access controls or attempt to reverse-engineer the Service;
  • submit automated requests in volumes that exceed normal use and impair service stability;
  • violate the Acceptable Use Policy of Anthropic, PBC.

Violations may result in immediate account suspension without refund and, where required by law, reporting to the relevant authorities.

8. Liability

The Provider's liability is governed by Swiss law. To the extent permitted by Art. 100 of the Swiss Code of Obligations (OR), the Provider excludes liability for indirect or consequential damages, including but not limited to loss of profit, loss of data, or business interruption.

Liability for direct damages is limited to the amount paid by the Customer for the specific job that caused the damage. This limitation does not apply to damages caused by gross negligence or intentional misconduct by the Provider.

9. Data protection

The Provider processes personal data in accordance with the Swiss Federal Act on Data Protection (nDSG) and, where applicable, the EU General Data Protection Regulation (GDPR). Details of data processing practices are set out in the Privacy Policy, available on the website.

Personal data is collected solely for the purposes of account management, billing, and service delivery. The Provider does not sell or share personal data with third parties for marketing purposes.

10. Amendments

The Provider may amend these Terms at any time. Customers will be notified of material changes by email at least 14 days before the new Terms take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If the Customer does not accept the changes, they may delete their account before the effective date without penalty.

11. Governing law and jurisdiction

These Terms are governed exclusively by Swiss law, to the exclusion of conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Interlaken-Oberhasli, Canton of Berne, Switzerland. The Provider reserves the right to take legal action before the courts at the Customer's place of domicile.
